上陸基準省令とは？

What is the “Landing Criteria Ordinance”?

 

出入国管理法には「上陸基準省令」という規定があり、「経営・管理」ビザを申請

する際にはこの基準に合致している必要があります。

Japan's Immigration Control Act includes a rule called the Landing Criteria Ordinance.
To obtain a “Business Manager” visa, you must comply with it.

「申請に係る事業を営むための事業所が本邦に存在すること。
ただし、当該事業が開始されていない場合にあっては、

当該事業を営むための事業所として

使用する施設が本邦に確保されていること。」

“The business office for conducting the business related to the application must exist in Japan.
However, if the business has not yet commenced, a facility in Japan that will be used as the business office must have already been secured.”

 

自宅での開業は可能か？

Can I Use My Apartment as an Office?

 

「住居として借りている場所でもOKですか？」という質問は非常に多いです。
この点については、出入国在留管理庁が公表している以下のような明確なガイドラインがあります。

 

「経営・管理」の在留資格の明確化等について：

「住居として賃借している物件の一部を使用して事業が運営されるような場合には、
住居目的以外での使用を貸主がみとめていること

（事業所として借主と当該法人の間で転貸借されることにつき、貸主が同意していること。）、
借主も当該法人が事業所として使用することを認めていること、
当該法人が事業を行う設備等を備えた事業目的占有の部屋を有していること、
当該物件に係る公共料金等の共有費用の支払いに関する取決めが

明確になっていること及び看板類似の社会的標識を掲げていることを必要とします。」

 

In cases where a portion of a residence that has been leased as a dwelling is used for business operations, the following conditions must be met:

• The lessor must permit usage of the property for purposes other than residential (i.e., the lessor consents to subleasing the space to the corporation as a business office);
• The lessee must also permit the corporation to use the property as its business office;
• The corporation must have a room exclusively used for business purposes, furnished with necessary equipment for conducting its business;
• Arrangements concerning the payment of shared expenses such as utility fees related to the property must be clearly defined;
• A socially recognizable signboard (or similar indicator) bearing the corporation’s name must be displayed.

• 郵便受けに法人名が明記されていること
  Your company name must appear on the mailbox.
• 専用の業務スペース（パソコン・プリンター・書庫など）があること
  There must be a room clearly separated and equipped for business only (PC, desk, printer, etc.).
• 公共料金などの取決めが明確になっていること
  Utility cost-sharing agreements must be clearly documented.
